Robbery Defined

Here are a variety of different charges under Florida Robbery Law and each has a different set of requirements and each provide a separate level of punishment:

  • Robbery by Sudden Snatching (no force used)
    • 3rd Degree Felony
    • Punishable by up to:
      • 5 years prison
      • 5 years probation
      • Up to $5,000.00 in fines
  • Robbery (Strong Arm)
    • 2nd Degree Felony
    • Punishable by up to:
      • 15 years prison
      • 15 years probation
      • Up to $10,000.00 in fines
  • Robbery with Weapon (possessed a deadly weapon at time of Robbery, not necessary that the weapon be actually used)
    • 1st Degree Felony
    • Punishable by up to:
      • Minimum 34.5 months Prison
      • Maximum 30 years Prison
      • Maximum 30 years Probation
      • Up to $10,000.00 in fines
  • Robbery with a Firearm (possessed a firearm at time of Robbery, not necessary that firearm actually used)
    • 1st Degree Felony
    • Punishable by up to:
      • Life in Prison
      • Life of Probation
      • $15,000.00 of fines

Enhancements and Aggravators

Florida Law provides ways for the prosecution to enhance or aggravate your potential penalties based on a number of different factors.  If there is an injury to the victim you could be facing increased points on your criminal punishment scoresheet.

Additionally, Florida’s 10/20/life Law is often applied to robberies that allege the use of a firearm during the commission of the robbery.  If you are accused of actually possessing the firearm during the Robbery, you can be sentenced under Florida’s 10/20/Life Law.  This means that if convicted, you can be sentenced to a minimum 10 years for possession, minimum 20 years if the firearm was “discharged” or shot, and minimum 25 year prison term if someone is injured or killed by a firearm during the course of the Robbery.

Other enhancements include the Florida Mask enhancement which provides enhanced penalties if you are alleged to have been wearing a mask during the commission of a robbery.  Also the Gang Member enhancement allows the state or judge to add additional points to your criminal punishment score sheet if you are proved to be a gang member at the time you allegedly committed the robbery.
